VemmaBuilder™ Anti-Spam Policy

We enjoy doing business with you on the Internet, but we do insist that you obey one hard and fast rule.  NO SPAM is allowed.  PERIOD.  Our tolerance for spam is zero, zip, nada.  VemmaBuilder™ does NOT condone spam.

Spam Defined.  VemmaBuilder™ considers the following to be "spam":

Exceptions.  The ONLY exceptions to the above-listed prohibited acts are:

  1. Having your prospect log onto the Internet with you on the phone and walking them through the process of filling out the Pre-Enrollment Form.  Remember, they must enter their information themselves or you'll be in HUGE trouble.  You don't want to lose your terrific VemmaBuilder™ website, do you?
  2. Mailing to legitimate OPT-IN mailing lists, where the source does the mailing on a Member's behalf AND you do not advertise a VemmaBuilder™ URL.  But be cautious when selecting an opt-in mailing-list company!  Using any but highly reputable sources could result in spam complaints against you that lead to your suspension or termination.  (Make sure you verify that these companies are able to provide you proof of opt-in in case of a spam complaint.)
  3. Including information about VemmaBuilder™ in email acknowledgement messages to orders and inquiries you receive -- if you stated upfront that an acknowledgement would be sent.

We don't care how valuable, informative, or nice your content -- or intent -- is.  If the recipient didn't ask for it, your message or posting is spam.  And that's very, very bad.

Email Requirements.  All emails you send out must meet the following requirements:

  1. They must have a working opt-out link.  This link must be easy to see and read.  This link must remain active for at least 30 days after you send an email.
  2. You must promptly remove the recipient from receiving any further emails as soon as possible (but no later than 10 business days) after notification that the person has opted-out.
  3. Email subject lines and header information must not be deceptive.  The to and from addresses on the email cannot be materially false or misleading.
  4. By law, emails must include the valid physical postal address of the sender.
  5. Your From address must be accurate, working and checked regularly for responses or complaints regarding your email messages.

Spam Complaint Procedures.  If we receive a spam complaint concerning your activities, we'll contact you by email.  You'll have 48 hours in which to respond with proof that you haven't been spamming.  Failure to respond within 48 hours will result in suspension of your account.

What proof will be required?  If you advertise to leads purchased in bulk, you'll be expected to provide proof to us directly.  (It is your responsibility to obtain this proof for us, even if you must obtain it from your lead company.)  This proof should be in the form of web server and email logs that show the IP address of the user, that the user opted in for the specific information that you sent, and that the user then confirmed that they opted in (to prove that it was really them requesting the information).  This is the only way to verify this user was the one who actually requested such solicitation and that someone else didn't enter their email address.  If the lead company you are using cannot provide the proof that you will need, DO NOT use that company.

If you're found guilty of spamming the VemmaBuilder™ name or your VemmaBuilder™ website address (in any way), your account will be immediately terminated and your website will be deactivated without refund.  What's more, you'll be reported to your own ISP provider as a spammer, with possible termination of your account there as well.

Furthermore, if you violate our anti-spam policy, and it causes damage or loss to our servers, or causes normal service on one (or more) of our websites to be interrupted, you will be held liable for damages and loss of business.

We do understand that when you use any form of opt-in advertising, there's always a chance someone will make an unfounded complaint.  This is why you should design your ads to get interested parties to confirm their interest (by asking you for more information, etc.), so that you will have the proof required to refute any spam complaints.
